Resumo: | This paper focuses on access to information preserved in Brazilian public and private archives. Since Brazil itself has no general archive or information-access laws, to arrive at parameters for studying the local situation relevant international legislation is first analyzed and an overview presented on the main European and American archival institutions. The situation in Brazil is then examined from three basic perspectives: how national constitutions have dealt with the question of access to information (including the most recent, that of 1988); what is being proposed in different archive bills now under discussion in the national Congress; and what by-laws have been established by Brazilian archive institutions. In conclusion, som considerations are advanced on access to private sources within institutions housing this type of collection. |

Considerando que o Brasil não possui leis gerais sobre arquivos ou acesso à informação, as autoras partem de uma análise da legislação internacional sobre o tema, traçando um panorama geral dos principais arquivos europeus e norte-americanos, para que possam estabelecer parâmetros de reflexão sobre a situação local. Nesse sentido, a situação brasileira é vista a partir de três perspectivas básicas: como as constituições lidaram com o tema do acesso à informação (incluindo a mais recente, de 1988); o que tem sido proposto no projeto de lei sobre arquivos em discussão no Congresso e quais os regulamentos internos das diferentes instituições brasileiras que lidam com arquivos.
