Such troublesome scenario derives from the use of biased algorithms in law enforcement and reflects the need of an efficient legal tool capable of sustaining the pillars of fairness in the criminal justice system. Under such purpose, the adoption of exclusionary rules for the protection of the “true positives” can be seen as an adequate legal remedy against illegal detentions.

P. 76-83.Com a ascensão de programas de policiamento preditivo, atuações policiais enviesadas e encarceramentos discriminatórios têm se tornado mais comuns. A problemática decorrente do uso de algoritmos enviesados no policiamento denota a necessidade de ferramentas legais eficientes e capazes de manter a justiça no sistema penal.
