Discussing Black Entrepreneurship: Analysis on the Concept through Colombian and Brazilian Cases

Resumo: The paper discusses the concept of black entrepreneurship and its consequences for the law, drawing on the criticism of racism and race relations in Latin America. Therefore, first, it presents the characteristics of entrepreneurship within the framework of business law. From these attributes, it develops the central elements to identify the afro-entrepreneurship. In a second step, based on interviews with Black entrepreneurs held in Bogotá and Brasília, an open structure of the concept of afro-entrepreneurship is defined, connected with the daily life and the demands of the Black entrepreneurs themselves. Thereby, it is understood that this open conceptual structure is the most suitable for a field of research and intervention that is still incipient, respecting the definitions of the entrepreneurs themselves. In addition, it presents itself as more appropriate in the formulation of public policies and in the orientation of the legal system in the face of the challenges of racial equality and the fight against racism in the Americas, registered in the Brazilian Constitution of 1988 and the Colombian Constitution of 1991.

Em um segundo momento, a partir de entrevistas com empreendedores negros realizadas em Bogotá e Brasília, delimita-se uma estrutura aberta do conceito de afroempreendedorismo, conectada com o cotidiano e as demandas dos próprios comerciantes. Com isso, entende-se que essa estrutura conceitual aberta é a mais adequada a um campo de investigação e intervenção ainda incipiente, respeitando as definições dos próprios empreendedores.
