Resumo: The future of regulation imposes the need to think about regulations for the times and circumstances ahead. Regulatory responses to different social, economic, and environmental problems are confronted with a broad growth and acceleration of innovation and technology. In this sense, it is necessary to incorporate good regulatory practices that respond to the different challenges and paradigms in a balanced and rational way, moving away from fundamentalist positions. Based on this need and using a hypothetical-deductive methodology, this article aims to analyze futureproof regulation as a regulatory practice within the Brazilian regulatory ecosystem. It concludes that, based on the innovative principle, this type of regulation is a tool that allows us to understand and respond to the different social, economic and environmental needs and the rapid, disruptive and transformative changes brought about by new technologies. Regulations should give precedence to a broad content of social participation and interdisciplinary technical dialogue to manage regulatory processes and strategies. However, designing regulations through tools and methods to make public policies more effective and forward-looking is challenging for regulators. Future-proof regulation is designed as a stimulus or strategy in the face of this challenge.

Las respuestas regulatorias a los diferentes problemas sociales, económicos y medioambientales se enfrentan a un amplio crecimiento y aceleración de la innovación y la tecnología. En este sentido, es necesario incorporar buenas prácticas regulatorias que respondan a los diferentes retos y paradigmas de manera equilibrada y racional, alejándose de las posiciones fundamentalistas. A partir de esta necesidad, y utilizando una metodología hipotéticodeductiva, este artículo pretende analizar la “regulación a prueba de futuro” (“future- proof regulation”) como práctica regulatoria dentro del ecosistema regulatorio brasileño. Se concluye que, basándose en el principio innovador, este tipo de regulación se muestra como una herramienta que permite entender y responder a las diferentes necesidades sociales, económicas y medioambientales, así como a los cambios rápidos, disruptivos y transformadores, que traen consigo las nuevas tecnologías. Las regulaciones deben dar prevalencia a un amplio contenido de participación social y de diálogo técnico interdisciplinario para la gestión de los procesos y estrategias regulatorias. Sin embargo, diseñar regulaciones a través de herramientas y métodos para hacer que las políticas públicas sean más eficaces y con visión de futuro es un desafío para los reguladores. La regulación a prueba de futuro está concebida como un estímulo o estrategia frente a este desafío.O futuro da regulação impõe a necessidade de pensar em regulações para os tempos e circunstâncias que se avizinham. As respostas regulatórias aos diferentes problemas sociais, econômicos e ambientais são confrontadas com um amplo crescimento e aceleração da inovação e da tecnologia. Neste sentido, é necessário incorporar boas práticas regulatórias que respondam aos diferentes desafios e paradigmas, de forma equilibrada e racional, afastando-se de posicionamentos fundamentalistas. Com base nesta necessidade, utilizando-se uma metodologia hipotético-dedutiva, este artigo objetiva-se analisar a “regulação à prova do tempo” (“future-proof regulation”) como prática regulatória, dentro do ecossistema regulatório brasileiro. Conclui- se que, com base no princípio inovador, este tipo de regulação se mostra como uma ferramenta que permite compreender e responder diante das diferentes necessidades sociais, econômicas e ambientais, bem como as mudanças rápidas, disruptivas e transformadoras, trazidas pelas novas tecnologias. As regulações devem dar precedência a um amplo conteúdo de participação social e diálogo técnico interdisciplinar para a gestão de processos e estratégias regulatórias. Entretanto, projetar regulações através de ferramentas e métodos para tornar as políticas públicas mais eficazes e voltadas para o futuro, é um desafio para os reguladores.
