State regulation and telecommunications reform

Resumo: Since the 1980's the telecommunications sector has been the object of restructuring policies in several countries. The reforms, supported by market liberalization and the privatization of public operators, initially took place in the United Kingdom, being followed, in different ways, by other European, Latin American and Asian countries. The current telecommunication sector reform in Brazil began in 1997, with the promulgation of the Telecommunications Act, and the ulterior privatization of the Telebrás System and Embratel. The change includes the creation of a regulatory agency - Anatel -, articulated with the proposal of redefinition of the State¿s role from direct producer to regulator. This paper analyzes the telecommunications sector reform, proposing to understand it as worldwide phenomenon and to examine the new forms of public action based regulatory concepts and practices.

As reformas apoiadas na liberalização de mercados e privatização de operadores públicos foram conduzidas inicialmente pelo Reino Unido, sendo seguidas, de formas diferenciadas, por outros países da Europa, América Latina e Ásia. O processo atual de reforma do setor de telecomunicações no Brasil foi iniciado em 1997, com a promulgação da Lei Geral das Telecomunicações e posterior privatização do Sistema Telebrás e da Embratel. A mudança inclui a criação de um órgão regulador - a Anatel -, que é articulada à proposta de redefinição do papel do Estado, de produtor direto a regulador.
