Resumo: | This paper presents a diagnosis of the Brazilian philanthropic health sector, based on the identification and analysis of current legislation and on the distribution of the network of philanthropic hospitals and its production within the Brazilian Unified Health System (SUS). It subsidizes public policies and specific sector programs, offering elements for the understanding of the conflicting context in which the new legislation has been established, and characterizing the role played by the philanthropic sector in providing healthcare through SUS. The sector¿s legislation and regulation documents were analyzedin order to identify the requirements and the flow of the process of obtaining the philanthropy certification as well as tax exemption. The consistency between data from the Brazilian Council for Social Assistance (CNAS) and from SUS were also checked. The geographic distribution of hospital resources was defined, and the production profile of these units were analyzed, taking into account the authorizations for inpatient care paid by SUS in the first quarter of 1999. |

Provê elementos para o entendimento do contexto conflitante em que a nova regulamentação vem sendo estabelecida e caracteriza o papel do setor filantrópico na oferta de serviços de saúde ao SUS, objetivando fornecer subsídios para a formulação de políticas públicas e de programas específicos para o referido setor. No sentido de identificar as exigências e o fluxo para concessão do certificado de filantropia e isenções pertinentes, foram analisados leis, decretos, ordens de serviço e resoluções dos órgãos diretamente envolvidos no processo. Com o objetivo de verificar a consistência entre dados do Conselho Nacional de Assistência Social (CNAS) e do SUS, foram confrontados os cadastros de entidades filantrópicas do primeiro e os cadastros de unidades hospitalares e ambulatoriais do segundo.
