Procedural volume, vulnerability, and access to justice: relationship between judicialization and the health structure in Minas Gerais, Brazil

Resumo: The right to health is fundamental to life, being one of the main human rights. The realization of this right by the judicial system is a mechanism for the defense of citizens to ensure that the State complies with it through investments in the health structure and the implementation of public policies. This research sought to investigate the factors that influence the volume of health judicialization processes, clarifying the relationship between socioeconomic vulnerability, public health structure, and the structure of access to justice in the regions of the state of Minas Gerais, Brazil, in the period from 2015 to 2017. The research was based on primary and secondary data of the model variables, and a panel data analysis was carried out to validate the theoretical hypotheses and discuss results. It was observed, from empirical studies, that the judicialization of health has a greater volume of lawsuits in regions with less economic vulnerability, lesser structure of access to justice, and greater investment in the health structure, differently from the theoretical survey of the study hypotheses. It was expected that the degree of socioeconomic vulnerability would be decisive in the volume of judicialization. Therefore, the theoretical hypotheses have been refuted. It is suggested to include other variables referring to the public health structure and population’s demographic characteristics, such as, for example, those in the register of social assistance policies, for a new analysis of the hypotheses in future studies.

El derecho a la salud es fundamental para la vida, siendo uno de los principales derechos humanos. La vigencia de este derecho a través del sistema judicial es un mecanismo de defensa de la ciudadanía para asegurar que el Estado cumpla con su rol a través de inversiones en la estructura de salud y la implementación de políticas públicas. Se buscó investigar los factores que influyen en el volumen de los procesos de judicialización en salud, dilucidando la relación entre vulnerabilidad socioeconómica, estructura de salud pública y acceso a la justicia en los condados del Estado de Minas Gerais, en el período de 2015 a 2017. La investigación se se construyó a partir de datos primarios y secundarios sobre las variables del modelo, en el cual se realizó un análisis de datos de panel para validar hipótesis teóricas y discutir resultados. Se observó, según notas de estudios empíricos, que la judicialización de la salud tiene un mayor volumen de juicios en regiones con menor vulnerabilidad económica, menor estructura de acceso a la justicia y mayor inversión en estructura de salud, a diferencia del relevamiento teórico que sustenta las hipótesis. del estudio. A efetivação desse direito via sistema judiciário é um mecanismo de defesa de cidadãos para garantir que o Estado cumpra seu papel por intermédio de investimentos na estrutura de saúde e da execução de políticas públicas. Buscou-se investigar os fatores que influenciam o volume de processos de judicialização da saúde, elucidando a relação entre vulnerabilidade socioeconômica, estrutura de saúde pública e estrutura de acesso à justiça nas comarcas do estado de Minas Gerais, no período de 2015 a 2017. A pesquisa foi construída com base em dados primários e secundários sobre as variáveis do modelo. Procedeu-se à análise de dados em painéis para validação das hipóteses teóricas e discussão de resultados. Observou-se, conforme apontamentos de estudos empíricos, que a judicialização da saúde tem maior volume de processos em regiões com menor vulnerabilidade econômica, menor estrutura de acesso à justiça e maior investimento em estrutura de saúde, diferentemente do levantamento teórico de suporte das hipóteses do estudo. Esperava-se que o grau de vulnerabilidade socioeconômico fosse determinante no volume de judicialização. Sendo assim, as hipóteses teóricas foram refutadas.
