Precarity and flexibility in public sector fixed-term contracts: Perceptions of the Judiciary

Resumo: | Exploratory jurisprudential research of the decisions of the São Paulo Court of Justice (TJ-SP) between July 2019 and July 2020 reveals the main current legal controversies over the municipal and state public agents hired throughout fixed-term contracts, i.e., temporary civil servants (cf., Brazilian Federal Constitution, art. 37, IX). The research shows the difference in the legal rights granted to civil servants who are statutory and "celetistas" (in the Portuguese acronym), on one side, and temporary agents, on the other, generating tension between them. It suggests that reducing the fixed-term contracts precariousness should be an objective of the Administrative Reform. It also shows that even though the Judiciary is sensitive to the need for flexibility in public human resources management, the Court strives to prevent the fixed-term contracts' uncontrolled expansion, to avoid the devaluation of the public tender institute in the hiring processes of public agents. |

Muestra la tensión que genera la diferencia de derechos entre agentes públicos estatutarios y celetistas (expresión del portugués), por un lado, y agentes públicos temporales, por otro. La investigación sugiere que la reducción de la precariedad de los temporales debe ser un objetivo de la Reforma Administrativa. También muestra que, si bien es sensible a la necesidad de espacios de flexibilidad en la gestión de los recursos humanos públicos, el Poder Judicial se esfuerza por evitar la expansión descontrolada de contrataciones temporales, para evitar la devaluación del instituto de licitación pública en la contratación de personal.Um levantamento jurisprudencial exploratório das decisões do Tribunal de Justiça de São Paulo (TJ-SP) entre julho de 2019 e julho de 2020 revela as principais controvérsias jurídicas atuais sobre as contratações temporárias de agentes públicos estaduais e municipais (Constituição Federal, art. 37, IX). O documento mostra a tensão gerada pela diferença de direitos entre os servidores estatutários e celetistas e os agentes temporários e sugere que a redução da fragilidade destes deve ser objetivo da reforma administrativa.
