Regendo a atividade regulatória: a nova legislação das agências reguladoras federais no Brasil

The trials and regulatory institutions are part of the government agenda, since it is a dynamic subject that involves change in the administrative culture of the country. One of the major challenges of Brazilian regulatory agencies has been to carry out their duties independently and impartially with the aim of promoting confidence and transparency to the market and society. This study tried to do an analysis of the contents and implications of the changes ongoing in Brazil, especially those occured in the proposal sent by the Brazilian Federal Government to the national congress providing for the new General Law of Regulatory Agencies (Bill 3337/2004) with the aim of promoting changes in the model of institutional organization and functioning of the Brazilian Federal Regulators and its defining characteristics. In chapter 03 the Bill 3337/2004, and its substitutes, prepared by Mr Leonardo Picciani, were detailed in its main points. The next chapter, Regulatory Governance, presented the policies of regulatory reform, their challenges in Brazil, and outlined the Programme for Strengthening Institutional Capacity for Regulatory Management (PRO-REG) Chapter 05 presented the best practices for regulatory quality, emphasizing the importance of social participation in the regulatory process. International experience for quality was also exposed. In chapter 06, the regulatory oversight was conceived and justified. Through analysis of the topic, with great literature and documentary research, and interviews designed by the occupants of the two highest positions of the Superintendent of Supply of the National Petroleum, Natural Gas and Biofuels, sought to demonstrate the indispensability of the development and implementation of a regulatory quality strategy that enables a consistent approach.
