Resumo: In Brazil, the expansion of the over-indebtedness phenomenon has intensified in recent years with the democratization of credit and the incentive to consume, through the process of banking society. Despite the growing increase in the levels of population indebtedness, there is no adequate legal treatment in the Brazilian legal system that addresses the issue in order to provide financial recovery for debtors. Nevertheless, in other countries, such as the United States and France, the legislation has two procedures implemented in the respective legal systems for the treatment of the indebtedness of the natural person: (i) the partial or total remission or pardon of financial obligations that exceed the debtor's ability to pay (fresh start policy); and (ii) mechanisms for debt renegotiation. This dissertation intends to address the regulation of the legal treatment of excessive indebtedness in Brazil, encompassing the phenomenon of super indebtedness, based on a comparative study of the United States and France, in order to demonstrate the need for the construction of a formal bankruptcy system natural in Brazil. To do so, it will be analyzed what legal mechanisms are available for the treatment of excessive debt of natural persons in each of these jurisdictions. The objective of the research is to verify which lessons can be extracted and eventually applied to the improvement of the Brazilian regulatory environment. Its purpose is therefore to understand the legal alternatives existing in other countries and that could potentially be an inspiration for Brazilian legislators and regulators when reforming legislation in Brazil.

Embora haja o crescente aumento dos níveis de endividamento da população, não há tratamento jurídico adequado no ordenamento jurídico brasileiro que enderece o tema, de modo a proporcionar a recuperação financeira dos devedores. Não obstante, em outros países, como Estados Unidos e França, a legislação dispõe de dois procedimentos implementados nos respectivos ordenamentos jurídicos para o tratamento do endividamento da pessoa natural: (i) a remissão ou perdão, parcial ou total, de obrigações financeiras que ultrapassem a capacidade de pagamento do devedor (política do fresh start); e (ii) mecanismos de renegociação de dívidas. Esta dissertação pretende abordar a regulação do tratamento legal conferido ao endividamento excessivo no Brasil, abarcando o fenômeno do superendividamento, a partir de um estudo comparado dos Estados Unidos e da França, a fim de demonstrar a necessidade da construção de sistema formal de falência da pessoa natural no Brasil. Para tanto, será analisado quais os mecanismos legais disponíveis para o tratamento do endividamento excessivo de pessoas naturais em cada uma dessas jurisdições. O objetivo da pesquisa é verificar que lições podem ser extraídas e, eventualmente, aplicadas para a melhoria do ambiente regulatório brasileiro. description In Brazil, the expansion of the over-indebtedness phenomenon has intensified in recent years with the democratization of credit and the incentive to consume, through the process of banking society. Despite the growing increase in the levels of population indebtedness, there is no adequate legal treatment in the Brazilian legal system that addresses the issue in order to provide financial recovery for debtors. Nevertheless, in other countries, such as the United States and France, the legislation has two procedures implemented in the respective legal systems for the treatment of the indebtedness of the natural person: (i) the partial or total remission or pardon of financial obligations that exceed the debtor's ability to pay (fresh start policy); and (ii) mechanisms for debt renegotiation. This dissertation intends to address the regulation of the legal treatment of excessive indebtedness in Brazil, encompassing the phenomenon of super indebtedness, based on a comparative study of the United States and France, in order to demonstrate the need for the construction of a formal bankruptcy system natural in Brazil. To do so, it will be analyzed what legal mechanisms are available for the treatment of excessive debt of natural persons in each of these jurisdictions. The objective of the research is to verify which lessons can be extracted and eventually applied to the improvement of the Brazilian regulatory environment. Its purpose is therefore to understand the legal alternatives existing in other countries and that could potentially be an inspiration for Brazilian legislators and regulators when reforming legislation in Brazil.
