Resumo: Objective: to discuss the gains and problems generated by the impact that autonomy - through the consent form – and its legalization have caused in the relationship between doctor and patient. Methodology: the work was carried out from a review of the literature on the doctor-patient relationship today, using both authors in the field of law and medicine, in a critical perspective. Results: the concept of autonomy does not offer enough security to serve as a fundamental element of the doctor-patient relationship. The interference of the Law in the doctor-patient relationship brings positive and other aspects that threaten the quality of the bond. Conclusion: the attention autonomy generates in Law and Bioethics does not dispense other elements of interpersonal relationships that can provide greater gains in this connection.

Metodología: el trabajo se realizó en base a una revisión de la literatura sobre la relación médico-paciente actual, utilizando autores en el campo del Derecho y medicina, en una perspectiva crítica. Resultados: el concepto de autonomía no ofrece suficiente seguridad para servir como elemento fundamental de la relación médico-paciente. La interferencia del Derecho en la relación médico-paciente trae aspectos positivos y otros que amenazan la calidad del vínculo. Conclusión: la atención suscitada en Derecho y Bioética por la autonomía no prescinde de la observación e inclusión de otros elementos de las relaciones interpersonales que pueden proporcionar mayores ganancias en esta conexión.Objetivo: discutir os ganhos e problemas gerados pelo impacto que a autonomia – por meio da figura do consentimento – e sua juridificação têm causado na relação entre médico e paciente. Metodologia: o trabalho foi realizado a partir de revisão na literatura sobre a relação médico-paciente na atualidade, recorrendo-se tanto a autores da área do Direito quanto da medicina, numa perspectiva crítica. Resultados: o conceito de autonomia não oferece segurança suficiente para servir como elemento fundante da relação médico-paciente. A ingerência do Direito na relação médico-paciente traz aspectos positivos e outros que ameaçam a qualidade do vínculo.
