Health democracy, judicialization of politics and neoliberalism

Resumo: The purpose of this essay is to speculate on the reasons why the health legal literature has not focused more incisively on the most remote causes of the phenomenon of the health's judicialization and how this is directly related to the current democratic crisis. It is asserted that the concept of democracy supported by the legal health doctrine is a derivation of the idealized concept of democracy of liberalism, as it naively underestimates the degeneration of democracy in lobby and ignores the empirical studies of contemporary political science that point to the disinterest and the passionate behavior of citizens regarding public affairs. Furthermore, in praising an alleged democratic exercise via health lawsuits, health legal doctrine pays little attention to alternative explanations of the origin of the judicialization of politics, such as that offered by Ran Hirschl, who sustains that the increasing judicialization (juristrocracy) stems from a strategic agreement between the economic, political and legal elites for the hegemonic preservation of their interests and for the advancement of a neoliberal economic agenda. It is supported the hypothesis that the omission of the sanitary legal doctrine in regard to deeper explanations about the judicialization of politics is exactly related to this preservation of the interests of the legal elite. For this reason, in order to advance in the improvement of democracy, it is necessary to reflect on the structural causes of judicialization, and thus promote institutional reforms that mitigate both the influence of economic power in politics and the mechanisms of production of judicial activism.

Se dice que el concepto de democracia sustentado por la doctrina de la salud jurídica es una derivación del concepto idealizado de democracia del liberalismo, ya que ingenuamente subestima la degeneración de la democracia en el lobby e ignora los estudios empíricos de la ciencia política contemporánea que apuntan al desinterés y pasión de los ciudadanos en relación con los asuntos públicos. Además, al ensalzar un supuesto ejercicio democrático a través de demandas judiciales de salud, la doctrina jurídica de la salud presta poca atención a explicaciones alternativas del origen de la judicialización de la política, como la que ofrece Ran Hirschl, quien sostiene que la creciente judicialización (juristrocracia) surge de un acuerdo estratégico entre las élites económica, política y legal para la preservación hegemónica de sus intereses y para el avance de una agenda económica neoliberal. Se sustenta la hipótesis de que la omisión de la doctrina jurídica sanitaria para explicaciones más profundas sobre la judicialización de la política está exactamente relacionada con esta preservación de los intereses de la élite jurídica. Por ello, para avanzar en el mejoramiento de la democracia, es necesario reflexionar sobre las causas estructurales de la judicialización, y así promover reformas institucionales que mitiguen tanto la influencia del poder económico en la política como los mecanismos de producción del activismo judicial.O objetivo do presente ensaio é especular as razões pelas quais a literatura jurídica sanitária não se debruçou de maneira incisiva sobre as causas mais remotas do fenômeno da judicialização da saúde e como isso se relaciona diretamente com a crise democrática atual. Afirma-se que o conceito de democracia sustentado pela doutrina jurídica sanitária é uma derivação do conceito idealizado de democracia do liberalismo, porquanto ingenuamente subestima a degeneração da democracia em lobby e ignora os estudos empíricos da ciência política contemporânea que apontam o desinteresse e a passionalidade dos cidadãos com relação aos assuntos públicos. Além disso, ao exaltar um suposto exercício democrático via demandas judiciais de saúde, a doutrina jurídica sanitária dá pouca atenção a explicações alternativas sobre a origem da judicialização da política, tal como a oferecida por Ran Hirschl, o qual sustenta que a crescente judicialização (juristrocracia) nasce de um acordo estratégico entre as elites econômica, política e jurídica para a preservação hegemônica de seus interesses e para o avanço de uma agenda econômica neoliberal. Sustenta-se a hipótese de que a omissão da doutrina jurídica sanitária para com explicações mais profundas acerca da judicialização da política está relacionada exatamente com esta preservação de interesses da elite jurídica.
