Reproductive rights, family planning and assisted human reproduction in Brazil in the current state of the art

Resumo: Advances in science reproductive and technology reached levels never before imagined, providing the men and women unable to procreate by natural means the possibility to realize the dream of have a kid, however, the absence of a specific law in Brazil has led to abuses and moments of legal uncertainty. At the same time, the changes in the concept of family in Brazil led to a free format, where procreation is not more it’s function, but a mean to establish or increase the family entity and whose planning and exercise of reproductive rights fit exclusively to those who compose it.  This article aims to demonstrate the relationship between reproductive rights, family planning and assisted human reproduction and analyse the rules governing this type of medical treatment in Brazilian territory today.

Al mismo tiempo, los cambios en el concepto de familia en Brasil condujeron a un modelo libre, donde la procreación no es más función, sino un medio para establecer o aumentar la entidad familiar y cuya planificación y ejercicio de los derechos reproductivos son exclusivamente de aquellos que la componen.  Este artículo pretende demostrar la relación entre los derechos reproductivos, planificación familiar y reproducción humana asistida y analizar las normas que rigen este tipo de tratamiento médico hoy en territorio brasileño.Os avanços da ciência e da tecnologia reprodutiva chegaram a patamares nunca antes imaginados, proporcionando a homens e mulheres impossibilitados de procriar pelos meios naturais a possibilidade de realizar o sonho da filiação, todavia, a ausência de lei específica no Brasil tem conduzido a abusos e momentos de insegurança jurídica.
