RESUMO O objetivo do presente trabalho é a análise casuística da objeção de consciência nos contextos do serviço militar brasileiro e da medicina, que tem impacto no que se refere à recusa de profissionais de saúde em realizar o aborto, mesmo nas hipóteses legais, e à insurgência de testemunhas de Jeová em receber determinados tratamentos médicos. Para tal tarefa, foi utilizado o método dedutivo que consistiu na análise bibliográfica (doutrina, legislação e jurisprudência) sobre o tema. Chegou-se à conclusão de que essa rica matéria exige a atenção do legislador na positivação de normas que regulem o direito à objeção de consciência, porquanto fazem parte do rol de direitos assegurados pela Constituição brasileira. Contudo, os legisladores são omissos em sua abordagem e tal omissão resulta na necessidade de que o Judiciário intervenha na tutela ou não do direito à objeção de consciência. Palavras-Chave: Liberdade de consciência. Testemunhas de Jeová. ABSTRACT The aim of the present work is the casuistic analysis of the conscientious objection in the contexts of the Brazilian military service and of medicine, which has impact regarding the refusal of health professionals to perform abortion, even in the legal hypotheses, and the insurgency of Jehovah's Witnesses in receive certain medical treatments. For this task, the deductive method was used, which consisted on bibliographic analysis (doctrine, legislation and case-law) about the theme. The conclusion was that this rich matter requires the attention of the legislator in making norms that regulate the right to conscientious objection, as they are part of the list of rights ensured by the Brazilian Constitution. However, legislators are silent in their approach and such an omission results in the need for the Judiciary to intervene in protecting or not the right to conscientious objection.
