O Direito à cidade corresponde ao uso equitativo, justo e democrático da cidade. Para isso, ela deve apresentar uma gestão democrática feita pela participação da sociedade civil. O objetivo central desse texto é verificar algumas questões sobre a inefetividade da participação cidadã na configuração do espaço urbano. Observou-se que existem diversos degraus de participação popular, que vão desde um momento mais baixo, no qual a manipulação dos grupos excluídos é feita pelos poderosos, até um grau maior no qual o cidadão se torna uma parte integrante e atuante na produção do espaço urbano. Com isso, concluiu-se que mesmo que se tenha um arcabouço jurídico elogiado em matéria urbanística, sem a efetiva participação democrática a cidade continua com seu caráter de segregação. Sendo, por isso, urgente a reforma na gestão das cidades. Palavras-chave: Direito à Cidade. Participação Democrática. Escada de Arnstein. ABSTRACT  The right to the city corresponds to the equitable, fair and democratic use of the city. To do this, it must present a democratic management made by the participation of civil society. The central objective of this paper is to verify some questions about the ineffectiveness of citizen participation in the configuration of urban space. It was observed that there are several steps of popular participation, ranging from a lower moment, in which the manipulation of excluded groups is done by the powerful, to a greater degree in which the citizen becomes an integral and active part in the production of the urban space. With this, it was concluded that even if we have a praised legal framework in urban planning, without effective democratic participation, the city continues to be segregated.
