PRIVATE EDUCATION CONTRACTS AND THE CONTRACTUAL (RE)BALANCE IN PANDEMIC TIMES

Resumo: It aims to verify the possibility of revising contracts signed by private individuals and private educational institutions considering the abnormal situation of the COVID-19 pandemic. It is a theoretical, exploratory and qualitative research, developed with documentary, bibliographic and legislative sources, and the research technique used was the indirect documentary. The method of approach applied was the logical-deductive, initially considering the private educational system in Brazil, and then studying some aspects of contracts and their revision, following on to the analysis of education and employment in context of the COVID-19 pandemic. Then, the educational contracts are analyzed considering the Consumer Protection Code and the Civil Code, emphasized on the issue of tuition fees in private educational institutions in times of abnormality. As a result, it may be stated that is possible to review the contracts in order to rebalance them, in attempt to protect the consumer and also to preserve educational institutions, jobs and, the learning process.

Trata-se de uma situação muito recente, sobre a qual ainda não há um posicionamento unânime na doutrina, na jurisprudência e entre as autoridades públicas, observando-se, contudo, uma tendência a concessão da revisão contratual, mesmo que em variadas formas e porcentagens. Trata-se de uma pesquisa teórica, exploratória e de cunho qualitativo, composta por fontes documentais, bibliográficas e legislativas, sendo que a técnica de pesquisa utilizada foi a documental indireta. A metodologia utilizada foi a lógico-dedutiva, sendo que inicialmente se faz considerações acerca do sistema educacional privado no Brasil, e posteriormente estuda-se alguns aspectos sobre os contratos e sua revisão, e passa-se para a análise da educação e do emprego no contexto da pandemia da COVID-19. Em seguida, analisa-se os contratos educacionais face ao Código de Defesa do Consumidor e ao Código Civil, com ênfase à questão das mensalidades nas instituições educacionais privadas em tempos de anormalidade.
