PRIVATE EDUCATION CONTRACTS AND THE CONTRACTUAL (RE)BALANCE IN PANDEMIC TIMES

It aims to verify the possibility of revising contracts signed by private individuals and private educational institutions considering the abnormal situation of the COVID-19 pandemic. It is a theoretical, exploratory and qualitative research, developed with documentary, bibliographic and legislative sources, and the research technique used was the indirect documentary. The method of approach applied was the logical-deductive, initially considering the private educational system in Brazil, and then studying some aspects of contracts and their revision, following on to the analysis of education and employment in context of the COVID-19 pandemic. Then, the educational contracts are analyzed considering the Consumer Protection Code and the Civil Code, emphasized on the issue of tuition fees in private educational institutions in times of abnormality. As a result, it may be stated that is possible to review the contracts in order to rebalance them, in attempt to protect the consumer and also to preserve educational institutions, jobs and, the learning process.
