THE RIGHT TO HEALTH AND PUBLIC COSTING OF INFECTED PATIENTS BY COVID-19: : a legal-detailed analysis of the federative pact from the constitutional protection perspective

Resumo: | Under the juridical-sociological methodological approach, an analysis is made of the public costing of patients with hangings in the federative pact that is established in the Constitution of the Federative Republic of Brazil of 1988. The hypothesis of the work is the costing of the expenses of patients are made based on the division of competences among the federation entities, in a common way, supporting the system in proportion to their budgets. The work is justified in view of the pandemic installed by COVID-19 and the impact of expenses that bring to the Unified Health System. It is concluded that as a way to demonstrate this federative pact, there is the cost of the right to Brazilian health . It is part of a federative cooperative mechanism, in which the entities, unions, states, municipalities and the Federal District, are competent to deal with the theme. With this, the funding for the Unified Health System, a program created to guarantee universality in access to free health and public policies aimed at health, must come from the three entities of the federation. |

A hipótese do trabalho é que o custeio das despesas das/os pacientes é feito a partir da repartição de competências entre os entes da federação, de maneira comum, sustentando o sistema proporcionalmente aos seus orçamentos. O trabalho justifica-se tendo em vista a pandemia instalada pelo COVID-19 e os impactos de despesas que isso traz ao Sistema Único de Saúde. Conclui-se que o custeio do direito à saúde brasileira é um bom exemplo para demonstrar o pacto federativo. Ele faz parte de um mecanismo de cooperativismo federativo em que os entes, União, Estados, Municípios e o Distrito Federal, têm competência comum para tratar da temática.
