SYMBOLIC CONSTITUTION AND THE SOCIAL FUNCTION OF THE STATE IN GUARANTEING ACCESS TO JUSTICE

Resumo: The present work consists in studying the Brazilian legislation and those that hinder its application and the application material, more precisely how to relate the guarantee of access to justice. It deals with aspects related to symbolic legislation and what is the symbolic constitution and social function of the state in maintaining the right of access to justice. We sought to bring an analysis and definition of the terminology constitutional symbolism, as well as aspects related to the social functions of the state in application of law with emphasis on the fundamental and social requirements applicable in the Federal Constitution. It is added to the object of study of verification of the application of the right of access to justice, as a form of inclusion and normative ineffectiveness in the effective application of the institute. Visit the analysis of the normative legal applicability in contemporary times and the implication of the political field in the effectiveness of the materialization of rights and their influence on the procrastination of dilatory commitments and promises. Through this study, which shows the political aspect of constitutional names or, consequently, brings new modulations to social status, it is important to emphasize that it is up to the State to create mechanisms that effectively facilitate the normative application of the institute or the analysis and analysis, mainly to the population in compliance with the rules and choice of legislators. The methodological development consists of bibliographic analyzes using the analytical-synthetic method and follows as line of research the Social Function of Law and Interculturality, subarea Social Rights and Public Policies.

Faz-se abordagem acerca dos aspectos concernentes a legislação simbólica tal qual a constituição simbólica e a função social do Estado na consolidação do direito de acesso à justiça. Buscou-se trazer a análise e definição da terminologia simbolismo constitucional bem como os aspectos relativos às funções sociais do Estado na aplicação do direito com ênfase nas garantias fundamentais e sociais previstas na Constituição Federal. Agrega-se ao objeto de estudo a verificação da aplicação do direito de acesso à justiça como forma de inclusão e a ineficácia normativa na efetiva aplicação de tal instituto. Visou à análise da aplicabilidade jurídico-normativo na contemporaneidade e a implicação do campo político na efetiva materialização de direitos e sua influência na procrastinação de compromissos e promessas dilatórias. Por meio deste trabalho concluiu-se que o aspecto político se sobrepõe aos ditames constitucionais, o que consequentemente traz novas modulações ao estatuto social, sendo oportuno ressaltar que incumbe ao Estado a criação de mecanismos que efetivamente facilitem a aplicação normativa do instituto ora em análise e, sobretudo à população na observância das normas e escolha dos respectivos legisladores.
