International Production of Urban Informality and the “Informal Urban Nucleus” in Brazil

Resumo: The motto of this research is the recent Brazilian land regularization legislation, Law 13.465/2017, which created the neologism "informal urban nucleus" and formalized an approach to urban land exclusively as a real estate asset. Thus, efficiency in land use is sought from the broad title and insertion of assets in the said formal real estate market, assets that in the previous moment were also formally linked to the realization of rights to land tenure, housing, and the fulfillment of the social function of the property. This article presents a research theme, a working process, and some of its advances, its theoretical and conceptual links, part of the bibliographical review, research in Brazilian federal government and international agencies documents, and original and little explored research paths. It is, therefore, a synthesis of research in progress that aims to elaborate a more finished work on the origin of the informal term, its uses and meanings in different disciplines and contexts, until reaching the urban space production and reproduction. Spatial Circuits.El lema de esta investigación es la reciente legislación brasileña de regularización de tierras, la Ley 13.465/2017, que creó el neologismo “núcleo urbano informal” y constituyo un enfoque exclusivo del suelo urbano como un bien inmobiliario, buscando la efectividad en el uso del suelo desde una idea de amplia titulación y, consecuentemente, inserción de activos antes vinculados a la realización de derechos de propiedad y vivienda en el llamado mercado inmobiliario formal. Este artículo presenta un tema de investigación en curso y algunos de sus avances, sus vínculos teóricos y conceptuales, parte de la revisión bibliográfica, investigaciones en documentos del gobierno federal brasileño y de organismos internacionales, y caminos de investigación originales poco explorados hasta entonces. Se trata, por tanto, de una síntesis de investigaciones sobre desarrollo urbano que pretende elaborar un trabajo más completo sobre el origen del término informal, sus usos y significados en diferentes disciplinas y contextos, hasta llegar a la producción y reproducción de lo urbano. Circuitos espaciales.O mote desta pesquisa é a recente legislação de regularização fundiária brasileira, Lei 13.465/2017, que criou o neologismo “núcleo urbano informal” e formalizou uma abordagem exclusiva da terra urbana como ativo imobiliário, buscando eficácia no uso do solo a partir da mais ampla titulação e, consequentemente, inserção de ativos antes vinculados à realização de direitos à posse e à moradia no dito mercado imobiliário formal. Esse artigo apresenta um tema de pesquisa em andamento e alguns de seus avanços, suas vinculações teóricas e conceituais, parte da revisão bibliográfica, pesquisas em documentos do governo federal brasileiro e de agências internacionais e caminhos de pesquisa originais e pouco explorados até então. Trata-se, pois, de uma síntese de pesquisas acerca do desenvolvimento urbano que tem como objetivo elaborar uma obra mais acabada acerca da origem do termo informal, seus usos e significados em diversas disciplinas e contextos, até chegar a produção e reprodução do urbano.
