JUDICIALIZATION IN EARLY CHILDHOOD EDUCATION IN THE CITY OF RIO GRANDE AND ITS EFFECTS ON THE EDUCATION OF CHILDREN FROM 0 TO 3 YEARS OLD

Resumo: the article presents results of a research that has as its theme the judicialization of vacancies in Early Childhood Education. The objective is to analyze and problematize the growing demand for judicial processes for the effectiveness of vacancies in Early Childhood Education in the city of Rio Grande/RS, especially children from zero to three years old and their effects for this stage educational. Under a post-structuralist perspective, with contributions from Foucaultian Studies, the study takes the concept of biopolitical governance as an analytical tool. The following materials were analyzed: judicial injunctions on access to Early Childhood Education in the city of Rio Grande (RS); interview with a family that filed a lawsuit in order to obtain a place at the nursery; interview with the coordinator of the SMEd Enrollment Center; data from the School Census and the Data Management System from SMEd of Rio Grande (RS). The analyzes made it possible to understand that public policies aimed at children are constituted within the political rationality of our time. Therefore, looking at them means assuming that they act as a tool for conducting the conduct of children and their families. They also make itpossible to perceive that there is a weakening of the quality of care in view of the enforceability of the right and this occurs through the judicialization process. In that regard, the right of access seems to overlap with the right of quality.

El objetivo es analizar y problematizar la demanda cada vez mayor de procesos judiciales para la efectivización de plazas en la Educación Infantil en el municipio de Rio Grande/RS, especialmente en lo que dice respecto a los niños de cero a tres años de edad y sus efectos para esa etapa educacional. Bajo una perspectiva postestructuralista, con contribuciones de los Estudios Foucaultianos, el estudio toma el concepto de gubernamiento biopolítico como herramienta analítica. Fueron analizados los siguientes materiales: mandamientos judiciales que versan sobre el acceso a la Educación Infantil en el municipio de Rio Grande (RS); entrevista con una familia que ha entrado con un proceso judicial, con fines de obtener plazas en la guardería; entrevista con la coordinadora del Núcleo de Plazas de la SMEd; datos del Censo Escolar y del Sistema de Gestión de Datos de la SMEd de Rio Grande (RS). Los análisis posibilitaron la comprensión de que las políticas públicas dirigidas a la infancia se constituyen en el interior de la racionalidad política de nuestro tiempo. Por lo tanto, mirarlas significa asumir que estas actúan como una herramienta de conducción de la conducta de los niños y de sus familias. También posibilitan percibir que hay un debilitamiento de la calidad del atendimiento frente a exigibilidad del derecho y eso se da por medio del proceso de judicialización. En ese sentido, el derecho del acceso parece sobreponerse al derecho de la calidad.O artigo apresenta resultados de uma pesquisa que tem como tema a judicialização de vagas na Educação Infantil. As análises possibilitaram a compreensão de que as políticas públicas voltadas para a infância se constituem no interior da racionalidade política do nosso tempo. Portanto, olhá-las significa assumir que agem como uma ferramenta de condução da conduta das crianças e de suas famílias.Também possibilitam perceber que há uma fragilização da qualidade do atendimento frente à exigibilidade do direito e isso se dá por meio do processo de judicialização.
