From exception to democratic state: human rights and public policy in Brazil

Resumo: It is undeniable that Brazil has been going through a political, economic, social crisis and understanding the state's action in face of these problems has allowed us to understand our role as a citizen. In Brazil, the relationship between the State, Government, Society, Human Rights and Public Policy is complex. As part of the political structure of the State of Exception, human rights have been hit hard, which negatively reflects the efficiency of public policies. Thus, the present work aims to weave reflections on the concept, the origin, the role of the state, relating them to the principles of human law and their application in public policy. For this, we sought to present the theoretical-methodological procedures through bibliographic research. This article does not intend to exhaust the subject nor to present definitive solutions, but to present reflections on the importance of Human Rights to sustain the Democratic Rule of Law that we live, with the objective, greater of the common good.

No Brasil, a relação existente entre o Estado, Governo, Sociedade, Direitos humanos e Políticas Públicas é complexa. Como parte da estruturação política do Estado de Exceção, os direitos humanos vêm sofrendo duros golpes o que reflete negativamente na eficiência das políticas públicas. Dessa forma o presente trabalho tem como objetivo tecer reflexões sobre o conceito, a origem, o papel do Estado, relacionando-os aos princípios dos Direito Humanos e sua aplicação nas Políticas Públicas. Para isso, buscou-se utilizar dos procedimentos teórico-metodológicos através de pesquisas bibliográficas.
