Discussion and analysis of the changes in CBJD for the football referee

Resumo: Since 2003, with the approval of the Brazilian Code of Sports Justice (CBJD), it came to disciplining all sport members of the National System of Sports. This Code regulates the all persons conduct involved in the sport. Given the controversy surrounding the role of referees, the Code has devoted numerous articles to them. Despite being in use shortly, the CBJD has undergone some revisions, the last in 2009, these revisions significantly changed its structure and content. Therefore, the aim of this study was to analyze and discuss the innovations brought by the promulgation of the Brazilian Code of Sports Justice latest version, referring to the football referee. After this retrospective analysis we can conclude that with the revision of CBJD of the 29 articles that mentioned the football referee, 16 were withdrawn. However, some of the behaviors mentioned in these articles retrieved were incorporated into new articles or added to other articles. Thus, the referee came to be mentioned in 20 articles in the new version. Another remarkable fact in this latest release was the introduction of a monetary penalty in several articles, being shown that some actions of conflict occurring in the sport can be settled in money. The reduction of many feathers was another important factor in the revision of the Code, which can lead to increased violence in the sport places.

Este Código rige la conducta de todas las personas vinculadas al deporte. Ante la controversia en torno a la actuación de los árbitros, el Código les dedicó numerosos artículos. A pesar de tener una vigencia breve, el CBJD sufrió algunas revisiones, la última en 2009, revisiones que modificaron significativamente su estructura y contenido. Por lo tanto, el objetivo de este estudio fue realizar un análisis y discusión de las innovaciones traídas por la promulgación de la última versión del Código de Justicia Deportiva Brasileño, referente al árbitro de fútbol. Luego de este análisis retrospectivo, se puede concluir que con la revisión del CBJD, de los 29 artículos que mencionaban al árbitro de fútbol, ​​16 fueron eliminados. Sin embargo, algunos de los comportamientos mencionados en algunos de estos artículos retirados se incorporaron a artículos nuevos o se agregaron a artículos existentes. De esta forma, el árbitro pasó a ser mencionado en 20 artículos en la nueva versión del Código. Otro hecho destacable en esta última versión fue la introducción de la sanción pecuniaria en varios artículos, demostrando que algunas acciones conflictivas que se dan en el deporte pueden resolverse con dinero. La reducción de muchas penas fue otro factor importante en la revisión de este Código, lo que puede conducir a un aumento de la violencia en los recintos deportivos.A partire dal 2003, con l'approvazione del Codice brasiliano di giustizia sportiva (CBJD), ha iniziato a regolamentare tutti gli sport che fanno parte del Sistema sportivo nazionale. Il presente Codice disciplina i comportamenti di tutte le persone legate allo sport. Il Codice, vista la controversia che circonda l'operato degli arbitri, gli ha dedicato numerosi articoli. Nonostante sia in vigore da poco tempo, il CBJD ha subito alcune revisioni, l'ultima nel 2009, revisioni che ne hanno modificato notevolmente la struttura e il contenuto. Pertanto, l'obiettivo di questo studio è stato quello di svolgere un'analisi e una discussione delle innovazioni apportate dalla promulgazione dell'ultima versione del Codice brasiliano di giustizia sportiva, con riferimento all'arbitro di calcio. Dopo questa analisi retrospettiva, si può concludere che con la revisione del CBJD, dei 29 articoli che menzionavano l'arbitro di calcio, 16 sono stati rimossi. Tuttavia, alcuni dei comportamenti menzionati in alcuni di questi articoli ritirati sono stati incorporati in nuovi articoli o aggiunti ad articoli esistenti. In questo modo l'arbitro ha iniziato ad essere citato in 20 articoli nella nuova versione del Codice. Un altro fatto degno di nota in quest'ultima versione è stata l'introduzione della sanzione pecuniaria in diversi articoli, a dimostrazione che alcune azioni conflittuali che si verificano nello sport possono essere risolte con il denaro. Apesar de estar em vigor a pouco tempo, o CBJD, passou por algumas revisões sendo a última no ano de 2009, revisões estas que modificaram de forma significativa sua estrutura e conteúdo. Assim sendo, o objetivo deste estudo foi realizar uma análise e discussão das inovações trazidas pela promulgação da última versão do Código Brasileiro de Justiça Desportiva, referente ao árbitro de futebol.
