Desse modo, o problema central da presente pesquisa pode ser formulado da seguinte maneira: quais são os critérios que justificam, legitimamente, a instauração de uma investigação preliminar, restringindo ou podendo restringir direitos fundamentais do imputado? Em resposta a ela, tem-se como hipóteses que: 1) a justa causa deve ser reconceituada, porque a sua análise deve ser antecipada para a fase preliminar de investigação, precisamente pelo fato de ser este âmbito o que mais afeta ou pode afetar os direitos fundamentais do imputado, vez que algumas garantias, como o contraditório e a ampla defesa, incidem de forma obrigatória exclusivamente a partir da propositura da ação penal. Ou, de outro modo: se no curso do processo, em que todas essas garantias constitucionais são necessárias, a justa causa deve ser também exigível, com muito mais razão, na fase preliminar, onde aquelas garantias são apenas insinuadas ou reflexas; 2) os critérios para a instauração de uma investigação criminal são os seguintes: a) tipicidade aparente; b) antijuridicidade aparente; c) condições de procedibilidade; d) originalidade aparente; e e) punibilidade concreta aparente. Com a confirmação dessas hipóteses, analisar-se-á a justa causa para a instauração de cada procedimento investigatório criminal realizado pela Polícia. A abordagem do tema será feita predominantemente com base no método dedutivo, uma vez que se lança mão de uma cadeia de raciocínio decrescente de análise, do geral para o particular, a fim de se chegar a uma conclusão acerca do problema investigado. O método de procedimento utilizado será basicamente o monográfico, haja vista que será aprofundado o estudo de um único tema. A técnica de pesquisa a ser adotada, por seu turno, será basicamente a revisão bibliográfica.The goal of this current research is to analyze the pre-existing and stablish new parameters of legitimation of the State justice system intervention in the preliminary criminal investigation, in other words, the probable cause to the initiation of the several criminal investigative procedures and the consequential identification of the fundamentals and constitutional boundaries of the preliminary phase of the national criminal procedure. On this matter, the main problem of the current research can be formulated as follows: Which criteria justify, legitimately, the initiation of a preliminary investigation, restraining or with the possibility of restrain the fundamental rights of the imputed? In response, the hypothesis are: 1) The probable cause must be reconceptualized, because its analysis must be anticipated to the preliminary phase of the investigation, precisely by the fact that this scope the one that most affects or can affect the fundamental rights of the imputed, give that some warranties, like the contradictory and full defense, appear in mandatory form exclusively from the proposition of the criminal accusation. Or, in another way: if in the criminal procedure, where all these constitutional warranties are needed, the probable cause must also be demanded, with more reason, in the preliminary phase, where those warranties are only insinuated or reflexed; 2) The criteria of the instauration of a criminal initiation are the following: a) apparent typicality; b) apparent anti-legality; c) conditions of processability; d) apparent originality; and e) apparent concrete punishability. With the confirmation of these hypothesis, it will be analyzed the probable cause to the instauration of each criminal investigatory procedure executed by the Police. The theme’s approach will be made predominantly based on the deductive method, since it uses a decrescent reasoning chain of analyses, from general to private, in order to reach a conclusion about the investigated problem. The utilized procedure’s method is going to be basically monographic, considering that the study of only one theme will be deeply probed.
