Resumo: A proposal is presented to bring in the case of accidents in the nuclear energy ambit, bring, to the nuclear-juridical area a profound analysis of the quantitative and qualitative limitations and the based on the Brazilian legislation. Proposals that reflect the real necessities of the area providing protection to the population and the environment without compromising the development in the nuclear area will be discussed. A juridical profile of the 1987 radiological accident in Goiania, Brazil, is presented, considering, the civil liability and application of the Exarcebated Risk Theory.
