Resumo: | The Federal Constitution enunciates the principle of legality, bringing together and ordering the main functions of the State Powers, responsible for preparing, interpreting and executing normative acts in a harmonious way (CF, arts. 2 and 5). The provision that the person is obliged to observe a certain behavior by force of law can favor respect for individual freedoms. The definition of the essential content and scope of fundamental rights is obtained by structuring its scope of protection, based on the limitations established in its regulations. On this point, Professor Ingo Wolfgang Sarlet notes that “the more precise the legal treatment (normative and dogmatic) of the problem of limitations and its own limits, whether through direct constitutional regulation or through the action of doctrine and jurisprudence, the more the necessary tribute will be paid to the demands of legal certainty” (SARLET, Ingo Wolfgang. The Efficacy of Fundamental Rights, 13th ed., Porto Alegre: Livraria do Advogado Editora, 2021, p. 405). The delimitation of the object requires the identification of the protected property, as well as the consideration of constitutionally established purposes. The legal norms, by detailing the rights, enable their exercise. However, it is necessary to consider the legal security that, as a subprinciple of the Rule of Law, portrays protection for the individual, inserted in citizenship relations, demanding the stability of relations and the preservation of legitimate trust.
