Resumo: O presente estudo se propõe conceituar a ortotanásia e analisar as implicações da ausência legal sobre a prática do procedimento no Brasil, à luz de princípios éticos. Através de uma metodologia documental e bibliográfica, apresenta-se o conceito de ortotanásia, com a respectiva interpretação, no âmbito constitucional e no âmbito religioso. Aponta-se, depois, seja para as implicações da ausência de legalização da ortotanásia no Brasil, como também para a proposta da sua legalização. Por fim, apresenta cinco princípios éticos inspiradores da medicina paliativa.

Por fim, apresenta cinco princípios éticos inspiradores da medicina paliativa. The paper aims propose to conceptualize orthothanasia and to analyze the implications of legal absence on the practice of the procedure in Brazil, in the light of ethical principles. Through a documentary and bibliographical methodology, the concept of orthothanasia, with the respective interpretation, is presented in the constitutional scope and in the religious scope. It is then pointed either to the implications of the absence of legalization of orthothanasia in Brazil, as well as to the proposal of legalization.
