The intervention of urban legislation as of the example of uninhabited colonial houses in noble neighborhoods in São Paulo city

Resumo: This article intends to address the consequences of the urban legislation intervention, analyzing its impact over the healthy growth of the cities. To illustrate it clearly, it will be analyzed the current situation of colonial houses which haven’t been either inhabited or underused in the Jardins’ region and surrounding areas, the pressure of groups of residents so as to maintain the rules besides the negative impact that the neighborhood causes to the rest of the city. In order to contextualize it, we will see a part of the story that tells how the urban legislation was made in the capital of São Paulo and it will help us understand the problems caused by it. We will also see, throughout the story, that the land use policies carried an excluding nature and that its use was related to the status quo maintenance.

Para contextualizar, veremos parte de la historia de cómo la legislación urbana fue construida en la capital, sirviendo de base para la comprensión de los problemas generados por ella. También veremos que, a lo largo de la historia, la zonificación estuvo cargada de un carácter excluyente, y su utilización ligada al mantenimiento del status quo.Este artigo pretende abordar as consequências do intervencionismo da legislação urbana, analisando o seu impacto sobre o crescimento saudável das cidades. Com o intuito de ilustrar, será analisada a situação atual dos casarões que se encontram vagos ou subutilizados nas regiões dos Jardins e o seu entorno, e as pressões de grupos de moradores para a manutenção de tais regras, sem levar em conta o impacto negativo que o bairro hoje gera para o resto da cidade. Para contextualizar, veremos parte da história de como a legislação urbana foi construída na capital paulista, servindo de base para a compreensão dos problemas gerados por ela.
