The economical intervention as the genesis of the imbalance of Brazilian markets: and the new paradigm proposed by the recent legislative changes

Resumo: The article investigates the relation between state-owned intervention and consumers‘ freedom, aiming to identify what gives genesis to the imbalances in Brazilian markets. For this, the interventionist model is approached, investigating its theoretical basis and its empirical fruits, through the analysis of highly renowned international and national reports and indicators on the theme. A brief study of consumer law was also carried out in order to provide a pragmatic criticism, identifying how it is currently revealed and its importance in the Brazilian scenario. It was concluded that Brazil, through state-owned interventionism - and its unrestraining use - in all market segments, makes its consumers vulnerable, by the creation of state-owned monopolies, legalized oligopolies and full cartels. Arise as a consequence, above all, the suppression of consumers‘ freedom and the planned distribution of consumer markets to suppliers selected by political interest.

Para ello, se aborda el modelo intervencionista, indagando sus bases teóricas y sus frutos empíricos, mediante el análisis de informes e indicadores internacionales y nacionales de gran renombre sobre el tema. También se realizó un breve estudio de la legislación sobre el consumo para tejer una crítica pragmática, identificando cómo se revela actualmente y su importancia en el escenario brasileño. Se llegó a la conclusión de que el Brasil, mediante el intervencionismo estatal, y su uso desenfrenado, en todos los segmentos del mercado, hace vulnerables a sus consumidores, mediante la creación de monopolios estatales, oligopolios legalizados y cárteles completos. Como consecuencia, sobre todo, surge la supresión de la libertad de los consumidores y la distribución planificada de los mercados de consumo a proveedores seleccionados por interés político.O artigo investiga a relação entre intervenção estatal e liberdade econômica, que compõem o núcleo da constituição econômica brasileira, questionando seu equilíbrio institucional, tendo como background crítico a perspectiva austríaca. Para isso, aborda-se o modelo intervencionista, indagando sua teoria, fundamentos e operação, em que se constatou sua incidência nos mercados, tanto direto (monopólios estatais e oligopólios legalizados), como indireto (tributação, benefício fiscal e burocracia). Além disso, examinaram-se dois relatórios e quatro importantes indicadores acerca da temática, buscando ratificar empiricamente as constatações levantadas.
