The American liberal constitutionalism in judicial review: an analysis of judicial debates over contractual freedom and private property in the Lochner Era (1897-1937)

Resumo: Abstract: This article intends to demonstrate the essence of the hermeneutic paradigm of interpretation of the constitution, in the period between the Independence of the United States (1789), motivated by the abusive laws of state intervention in the economy, and the years that preceded the beginning of the Second World War (1939). This is because the paradigm (model/standard) of interpretation and application of constitutional precepts underwent a change at the end of the 19th century, in which the defense of individual freedom was left aside by the legal community, starting to relativize these constitutional norms in favor of State intervention in the economy. These liberal precepts had been enshrined in the declarations of rights of the end of the 18th century, originating from the French Revolution and the American Revolution, but they lost strength with the advent of socialism and the theses of social constitutionalism in the 20th century.

Esto se debe a que el paradigma (modelo / estándar) de interpretación y aplicación de los preceptos constitucionales sufrió un cambio a fines del siglo XIX, en el que la defensa de la libertad individual fue dejada de lado por la comunidad jurídica, comenzando a relativizar estas normas constitucionales en favor de Intervención estatal en la economía. Estos preceptos liberales habían sido consagrados en las declaraciones de derechos de finales del siglo XVIII, con origen en la Revolución Francesa y la Revolución Americana, pero perdieron fuerza con el advenimiento del socialismo y las tesis del constitucionalismo social en el siglo XX.O presente artigo pretende demonstrar a essência do paradigma hermenêutico de interpretação da constituição, no período entre a Independência dos Estado Unidos (1789), motivada pelas leis abusivas de intervenção estatal na economia, e os anos que antecederam o início da Segunda Guerra Mundial (1939). Isso porque, o paradigma (modelo) de interpretação e aplicação dos preceitos constitucionais passou por uma mudança no final do século XIX, em que se deixou de lado, por parte da comunidade jurídica, a defesa da liberdade individual, passando a relativizar essas normas constitucionais em favor da intervenção do Estado na economia.
