The origins of the antitrust movement: An Interest-Group Perspective

Resumo: | Several contemporary studies have highlighted the need to introduce competition in the transport, energy industries, as well as other markets held to be natural monopolies due to the inefficiency generated by government-regulated monopolies. However, little has been studied on the consequences of the regulation known as antitrust law; it dates back to a protectionist political process from the late 19th century, which laid the foundations for most government regulation on several industries accused of monopoly practices. The present article has studied the origins of the antitrust movement as a political initiative, analyzed the evidences of the industries accused of monopolization, and has proven the research hypothesis that antitrustlaws and their derivatives have actually restricted competition more than improved market performance by correcting alleged “market failures”. |

Mientras tanto, poco se estudia sobre las consecuencias de la regulación conocida como antimonopolio, que se remonta a un proceso político proteccionista de fines del Siglo XIX, y que sirvió de base para la mayor parte de la regulación gubernamental sobre diversas industrias acusadas de prácticas monopolistas. En este artículo, son estudiados los orígenes del movimiento antimonopolio como iniciativa política, son analizadas las evidenciassobre las industrias acusadas de monopolización, y se demuestra la hipótesis de estudio de que las regulaciones antimonopolio y sus derivadas han restringido la competición que mejora el desempeño de los mercados a través de la corrección de supuestas “fallas de mercado”.Diversos estudos contemporâneos evidenciam a necessidade de introdução da competição nos setores de transporte, energia e outros mercados tidos como monopólios naturais, devido à ineficiência gerada pelos monopólios regulados por agências governamentais. Entretanto, pouco se estuda sobre as consequências da regulação conhecida como antitruste, remonta a um processo político protecionista do final do Século XIX, e que serviu de base para a maior parte da regulação governamental sobre diversas indústrias acusadas de praticas monopolistas.
