Resumo: This article aims to analyze the enforceability of territorially protected spaces, specifically the legal reserve institutes and the permanent preservation area, as possible obstacles to legitimate sustainable development in small rural properties, given that these spaces limit some aspects of the law of property. Aspects about sustainable development, as well as property rights and constitutional protection of small rural properties will be analyzed. Concepts and legal consequences of territorially protected spaces will be addressed in order to analyze the possibility of reconciling the administrative limitations imposed by environmental legislation and the activity promoted on a small rural property, since the small rural producer maintains his livelihood of the inhabited property. Considering the socioeconomic needs of rural families, there is a need to adapt environmental legislation with regard to small rural properties, in order to enable true sustainable development.

Considering the socioeconomic needs of rural families, there is a need to adapt environmental legislation with regard to small rural properties, in order to enable true sustainable development.Este artigo tem como finalidade analisar a exigibilidade dos espaços territorialmente protegidos, especificamente os institutos da reserva legal e a área de preservação permanente, como possíveis dificultadores a um legítimo desenvolvimento sustentável nas pequenas propriedades rurais, tendo em vista que referidos espaços limitam alguns aspectos do direito de propriedade. Serão analisados aspectos acerca de desenvolvimento sustentável, bem como do direito de propriedade e a proteção constitucional do pequeno imóvel rural. Serão abordados conceitos e consequências legais dos espaços territorialmente protegidos com o fim de analisar a possibilidade de conciliação entre as limitações administrativas impostas pela legislação ambiental e a atividade promovida em uma pequena propriedade rural, vez que o pequeno produtor rural mantém seu sustento do imóvel habitado.
