The article deals with “Indigenous Fundamental Right to Land, with emphasis on the Yanomami Original Peoples”. In short, the problem was investigated: “How does the legal system interfere with the land rights of original peoples?” The following hypothesis was considered: “The legal system directly interferes with the right to land of indigenous peoples”. The general objective is to “Elucidate the right to indigenous land, with an emphasis on the Yanomami people”. The specific objective is to present a historical analysis of how the legal system influences indigenous peoples with the creation of internal and external laws and policies. The work was extremely relevant for a legal practitioner because it deals with the influence that the law has on a people; for science, it was important as it is a topic that is constantly changing and requires research; contributed to society due to the fact that the theme works to reduce social disparities. This is theoretical qualitative research lasting 10 months.
