Mediation as alternative to labor judicialization: unaviable rights for the enforcemente of individual agreement

Resumo: | The theme of this article is “mediation as an alternative to labor judicialization: unavailable rights for the achievement of individual agreement”. The following problem was investigated: “can the unavailability of labor rights mitigate agreements and harm the employee?”. The following hypothesis was considered “labor mediation does not protect rights in their entirety”. The overall objective is “to analyze whether mediation can lead to unfair settlements”. The specific objectives are: “to survey the current legislation on the subject”; “check if there are labor rights that can be mitigated”; “to analyze the applicability of mediation in labor relations”. This work is important for a legal practitioner due to the use of mediation in labor disputes; for science it is relevant for exposing the culture of extrajudicial conflict resolution and; adds to society the autonomy in litigation. This is a theoretical qualitative research lasting six months. |

Investigou o seguinte problema: “a indisponibilidade de direitos trabalhistas pode mitigar acordos e prejudicar o empregado?”. Cogitou a seguinte hipótese: "a mediação trabalhista não protege os direitos em sua integralidade”. O objetivo geral é “analisar se a mediação pode levar a acordos injustos”. Os objetivos específicos são: “levantar a legislação vigente sobre o tema”; “verificar se existem direitos trabalhistas que possam ser mitigados”; e “analisar a aplicabilidade da mediação nas relações trabalhistas”. Este trabalho é importante para um operador do Direito devido ao uso da mediação em conflitos trabalhistas; para a ciência é relevante por expor a cultura de resolução de conflitos extrajudiciais e agrega à sociedade na autonomia nas litigâncias.
