Organization and Legal Environment: The Social Construction of Civil Identity Single Registry in Brazil

Resumo: The purpose of this paper is to analyze the social construction of the Brazilian legal environment around the Federal Act 9.454/1997, which established the Civil Identity Registry in Brazil (RIC). We argue that the promulgation of the law is not enough for its social effectiveness; instead it depends on the articulation of public and private organizations on constructing answers to the legal text. We analyze how these organizations mobilize material and relational assets and frame their responses to legal rules. This study assumes that the applicability of legal texts is deemed on their interpretation, reach and validity in organizational fields. This implies different conceptions of legality. As such, we consider public and private organizations as engaged agents in politics of production and maintenance of meanings. Our research covers the period from 1997 to 2011, which comprehends the gap between the legal validity and the social effectiveness of the Federal Act 9.454/1997. We use longitudinal data based on documentary sources and sectional retrospective data based on semi-structured interviews. Thematic based qualitative content analysis was performed. We use a priori and emergent categories. The results show that both public and private organizations were engaged in the development of a shared interpretation of the law, although with different interests. Moreover, the findings revealed actions in conflict with institutionalized norms and contradictory to existent laws – but they were legitimized because of their adherence to a socially shared notion of legality. In conclusion, we argue that the notion of legitimacy and legality are intertwined through the shared meanings given to laws in an organizational field. As such, we contend the theoretical proximity between organizational institutionalism and sociology of law in order to consider the legal environment as partial content of the institutional context of organizations.

Partiendo del principio de que la vigencia legal no es suficiente para la vigencia social de una ley, este estudio se llevó a cabo con el fin de analizar la articulación de las organizaciones públicas y privadas en la construcción de respuestas al texto legal, por medio de la movilización de recursos materiales y relacionales así como estrategias de framing. La fundamentación del trabajo ocurre en la idea de que los textos legales están sujetos a interpretaciones sobre su aplicabilidad, el alcance y la validez en el campo organizacional, lo que implica aceptar diferentes concepciones de la legalidad. Con este fin, considerase organizaciones públicas ó privadas como agentes capaces de participar activamente en la política de producción y mantenimiento de significados. Los datos fueron analizados cualitativamente, teniendo en cuenta el período de 1997 hasta 2011, marcado por el déficit entre la vigencia legal y la vigencia social de la referida ley. Utilizamos datos longitudinales basados en fuentes documentales y datos seccionales-retrospectivos tomados de entrevistas semi-estructuradas. Se realizó un análisis temático de contenido cualitativo. Utilizamos categorías a priori y emergentes. Los resultados mostraron que la participación de las organizaciones públicas y privadas con intereses diferentes, ocurrió por medio de actividades guiadas por esfuerzo de la interpretación compartida acerca de la legalidad. Se observó también acciones que entraban en conflicto con los parámetros institucionalizados y que contrariaban  leyes existentes – y que así mismo fueron legitimados por su adhesión a la noción socialmente compartida de legalidad. La conclusión es que la noción acerca de la legitimidad y de la legalidad se articula a través de significados dados a las leyes y compartido entre los actores del campo organizacional. Como tal, sostenemos la proximidad teórica entre institucionalismo organizacional y la sociología del derecho a fin de considerar el ambiente legal como contenido parcial del contexto institucional de las organizaciones.O presente artigo visa compreender a influência da articulação de organizações públicas e privadas, por meio da mobilização de recursos e estratégias de framing, no processo de construção social da Lei Federal no 9.454/1997, que instituiu o Registro Único de Identificação Civil brasileiro (RIC) no período 1997-2011. O trabalho se fundamenta na ideia de que textos legais são passíveis de interpretações acerca de sua aplicabilidade, alcance e validade no campo organizacional, o que implica admitir diferentes concepções de legalidade. Para tanto, considera organizações públicas e privadas como agentes engajados na política de produção e manutenção de significados legais. A coleta dos dados considerou fontes documentais, tratadas longitudinalmente, e entrevistas semiestruturadas, de natureza seccional retrospectiva. Utilizou-se análise qualitativa de conteúdo, de base temática, a partir de categorias pré-definidas e emergentes. O período considerado vai de 1997 a 2011, marcado pela lacuna entre a vigência legal e a vigência social da Lei Federal no 9.454/1997. Apesar dos interesses distintos, resultados evidenciaram o engajamento de organizações públicas e privadas com o compartilhamento de uma interpretação acerca da legalidade. Também foram constatadas ações que conflitavam com parâmetros institucionalizados e que contrariavam leis existentes – as quais foram legitimadas em função de sua aderência à noção de legalidade socialmente compartilhada. Conclui-se que noções de legitimidade e legalidade estão articuladas por meio do significado dado às leis e compartilhado entre os pares no campo organizacional.
