A mobilização NIMBY e sua relação com as dark kitchens em São Paulo

Resumo: Cities full of their meanings, places, people and different cultures, constantly face changing scenarios and these proposals in favor of local development, do not always please all audiences and can generate a certain opposition on the part of individuals. This context of opposition is related to the not in my backyard (NIMBY) concept, an expression used to demonstrate that a certain group of people, usually residents, is firmly opposed to the location of interventions made by the Public Power or by the private sector in the territory in which this group resides, for various reasons, but always of individual interest to the members of that group (or mobilization). Perhaps the NIMBY mobilization has always been present in the processes of change in urban regulation, but not exactly with this name, and may be capable of influencing urban planning. The present work examines the NIMBY mobilization, focusing on its presence in processes of alteration of urban regulation in cities, taking as a case study the city of São Paulo, more specifically the regulation process of Dark Kitchens, called ghost kitchens, which given the negative externalities generated, it generated mobilization in opposition on the part of residents around these units. As a result, it was observed that there was a considerable influence of the NIMBY mobilization in the process of regulating Dark Kitchens in the city of São Paulo, resulting in greater restriction for the development of this type of business and, at the same time, greater control over the negative externalities generated by these activities. The dissertation also reveals that the NIMBY mobilization has been present in Brazilian cities and in Brazil for much longer than imagined, but without the use of this denomination adopted in other countries.

Este contexto de oposição está relacionado ao conceito not in my backyard (NIMBY), que significa “não no meu quintal”, expressão utilizada para demonstrar que um determinado grupo de pessoas, geralmente moradores, se opõe firmemente a localização das intervenções feitas pelo Poder Público ou pela iniciativa privada no território em que esse grupo reside, por motivos diversos, mas sempre de interesse individual dos integrantes desse grupo (ou mobilização). Talvez a mobilização NIMBY sempre tenha estado presente nos processos de alteração da regulação urbana, porém não exatamente com esta denominação, podendo ser capaz de exercer influência no planejamento urbano. O presente trabalho examina a mobilização NIMBY, com foco na sua presença em processos de alteração da regulação urbana nas cidades, tomando como estudo de caso a cidade de São Paulo, mais especificamente o processo de regulamentação das Dark Kitchens, chamadas de cozinhas fantasmas, que diante das externalidades negativas geradas, gerou mobilização em oposição por parte dos moradores do entorno dessas unidades. Como resultado, observou-se que houve considerável influência da mobilização NIMBY no processo de regulação das Dark Kitchens na cidade de São Paulo, resultando em maior restrição para o desenvolvimento desse tipo de negócio e ao mesmo tempo maior controle sobre as externalidades negativas geradas por estas atividades.
