The new bidding law: legal and economic impacts

Resumo: This article aims to analyze the new bidding law, and the impacts on society. It seeks, thus, to bring some aspects of its legislative process, drawing a comparison between the old law and the new law, highlighting some points that made the change necessary. In addition, it intends to analyze the constitutional aspects of the new bidding law, as well as some of its main innovations for Administrative Law. And, in this context, an analysis is presented on the role of the TCU, as well as its activity in light of the bidding law. Finally, after the legal analysis, we will study some possible financial and economic impacts arising from the new law.

Busca, assim, trazer alguns aspectos do seu processo legislativo, traçando um comparativo entre a lei antiga e a nova lei, destacando alguns pontos que tornaram necessária a mudança. Além disso, pretende-se analisar os aspectos constitucionais da nova lei de licitações, bem como algumas das suas principais inovações para o Direito Administrativo. E, nesse contexto, apresenta-se uma análise sobre o papel do TCU, bem como sua atividade desempenhada à luz da lei de licitações.
