Resumo: The subject of this article is parental alienation. The following problem was investigated: civil liability may occur in cases where parental alienation occurs. The following hypothesis was considered: it is possible that there is liability, since the state finds ways to sanction not only criminal bias, but also civil. The general objective is to explain the concept of civil liability alone, and in a second moment, applied to the family institute, to deal also with the species of civil liability and all the way to achieve liability. The specific objectives are: to address the possibility of imputing economic reparation for the disposal and the minor alienated by parents who alienate those for whom they are responsible as a pedagogical form and reparative sanction. This work is important from an individual perspective because of the possibility of studying concepts that are widely important for passing the test of order, now objectified; for science, it is relevant because it allows scientific proof of the need for accountability to society; It adds to society because it resolves conflicts outside the judiciary, as this method appears to be simpler. This is a theoretical qualitative research lasting six months.
