Resumo: In the face of the phenomenon of collectivization of rights, the participation of of the Judiciary in matters of great social relevance, called to decide through the analysis not only of the rule put forward, but, above all, of the contexts sociological, cultural, political and economic in which immersed society. The most important and challenging problems facing current, stem from massification. The answers previously offered by the system intersubjective conflicts (traditional individual conflicts) are insufficient for this new reality. Therefore, in seeking to offer more effective solutions to the new litigations deducted in court, the judiciary understood that it was essential to change the way Constitution and laws. Approaching the tangible reality, taking center stage in the political and social setting has become a requirement for Jurisdiction. As a consequence, the the role of instrument for a 'just' legal order and not only seeking to confer the maximum concreteness of the norms.

As a consequence, the the role of instrument for a 'just' legal order and not only seeking to confer the maximum concreteness of the norms.Diante do fenômeno da coletivização dos direitos, intensificou-se a participação do Poder Judiciário em questões de grande relevância social, chamado a decidir demandas de cunho coletivo mediante análise não apenas da regra posta, mas, sobretudo, dos contextos sociológico, cultural, polí­tico e econômico nos quais imersos a sociedade. Os mais importantes e desafiadores problemas que se propõem aos juristas, na atualidade, decorrem da massificação. As respostas anteriormente oferecidas pelo sistema aos conflitos intersubjetivos (tradicionais conflitos individuais) são insuficientes a esta nova realidade. Por isso, ao pretender oferecer soluções mais efetivas aos novos lití­gios deduzidos em juí­zo, o Poder Judiciário compreendeu ser imprescindí­vel mudar a forma de interpretar a Constituição e as leis. Aproximar-se da realidade tangí­vel, assumindo posição central no cenário polí­tico e social tornou-se uma exigência para a Jurisdição. Como conseqüência, o judiciário encampa o papel de instrumento para uma ordem jurí­dica "˜justa"™ e não somente jurí­dica, buscando conferir a máxima concretude das normas.
