The present study approaches the involvement of children in drug trafficking and considers said activity as one of the worst forms of child labour, as defined on International Labour Organization's Convention 182. The research methodology is bibliographic and documentary, especially ethnographic studies on the subject. Some of the violations of rights caused by their involvement in drug trafficking are presented, as also are presented the children's reality and the Brazilian State's lack of answer to the issue. When the Brazilian State does act, it tends to consider such activities as crimes. The hypothesis used on the present study is that the protection of the subjects' rights should be guided by a policy that strives to adhere to the norms of Human Rights above all others, treating them as children and adolescents involved in child labour, and not only as youthful ofenders. The conclusion is that the Brazilian war on drugs have to change to comply with the American Convention on Human Rights (art.19), in light of the Convention of the Rights of Child, the Convention 182 and the Recommendation 190 of the International Labour Organization.
