Resumo: In 1931, the Peruvian poet César Vallejo wrote the children's story “Paco Yunque” in which he denounced the Peruvian class and racist society that discriminated against the indigenous people. This situation is still very present not only in Peru, but throughout Latin America, despite the existence of constitutions instituting democratic states, which proclaim equality and freedom for all. This mismatch between norm and reality reveals how the encryption of law is used to maintain the hierarchical structure of our societies. In this context, the present study aimed to demonstrate the need to implement intercultural educational policies, as a way to emancipate the hidden indigenous people and recover their quality of political subject, in the terms proposed by Sanín Restrepo. To this end, bibliographic research was carried out on national and comparative doctrine, whose analysis was in line with the epistemological assumptions defended by the new Latin American constitutionalism. Finally, it was concluded that there is a need, first, to discuss and reformulate the epistemological bases of Latin American constitutionalism in order to later propose intercultural educational public policies, in order to reverse the unfair situation of discrimination that, in the 21st century, millions of Latin American Indians still face

Trata-se de uma situação ainda muito presente não apenas no Peru, mas em toda América Latina, apesar da vigência de constituições instituindo Estados democráticos, que proclamam a igualdade e a liberdade de todos. Esse descompasso entre norma e realidade revela como a encriptação do Direito é utilizada para a manutenção da estrutura hierárquica das nossas sociedades. Nesse contexto, o presente trabalho objetivou demonstrar a necessidade da implementação de políticas educacionais interculturais, como forma de emancipar o povo oculto indígena e recuperar sua qualidade de sujeito político, nos termos propostos por Sanín Restrepo. Com esse fim foi realizada pesquisa bibliográfica na doutrina nacional e comparada, cuja análise alinhou-se aos pressupostos epistemológicos defendidos pelo novo constitucionalismo latino-americano.
