Resumo: This article analyzes the relationship between the economy and the law in the construction of regulatory models of public services in Brazil, also using the study of two national experiences:  the rail sector and the electricity sector. It is not exactly a history of the regulation of public services, but a historical and economic analysis of the problem of the construction of models of provision that would fit each stage of the construction of the Brazilian State. There is a kind of paradox of a State that opts for a given model of provision while the legislation in force moves in the opposite direction. Open options, disputes, silenced voices, specific circumstances are elements that a long-term analysis tends not to address. However, the proposal presented here for the periodization of the models of provision of public services in Brazil is useful as it allows to observe the paradox, that is the object of this article.

Não se trata propriamente de uma história da regulação dos serviços públicos no país, mas de uma análise histórica e econômica do problema da construção de modelos de provisão que se adequassem a cada etapa da construção do Estado brasileiro. Sustenta-se aqui a existência de uma espécie de paradoxo de um Estado que opta por dado modelo de provisão enquanto a legislação em vigor caminha no sentido inverso. Opções em aberto, disputas, vozes silenciadas, circunstâncias específicas são elementos que uma análise de longo prazo tende a não abordar.
