Democratization of decision-making in the organizational environment against the democratic postulates of contemporary constitutionalism: the case of Mercur

Resumo: The article focused on the study of the democratization of decision-making within the organizational environment of Mercur, in which the extension of the democratic character beyond the relations involving the State and the citizen was analyzed, based on for the case study carried out in the Master's thesis in Law at the University of Santa Cruz do Sul. The approach consisted of presenting a contextualization about the context of Contemporary Constitutionalism and the central role of democracy, followed by the analysis of the theoretical postulates of participatory democracy based on Pateman's theory. Finally, it was sought to portray the rationality of the decision-making process, referencing the Mercur with the aim of evaluating whether the decision-making process of that organization meets the presuppositions of participatory democracy and the organizational fundamentals. The hypothetical-deductive model was applied as a method, covering bibliographical review procedures. The hypothesis raised was confirmed, namely, that Mercur's experience of decentralizing decision-making is a democratic model, meeting the parameters outlined by Pateman and authors who deal with of organizational management, moving towards a possible idea of full participation, in order to align with the constitutional precepts provided for in Federal Constitution of 1988.

A abordagem consistiu em apresentar uma contextualização acerca do cenário do Constitucionalismo Contemporâneo e o papel central da democracia, tendo por sequência a análise dos postulados teóricos da democracia participativa a partir da teoria de Pateman. Por fim, buscou-se retratar a racionalidade do processo de tomada de decisão, referenciando a Mercur com objetivo de avaliar e se a tomada de decisão da referida organização atende os pressupostos da democracia participativa e dos fundamentos organizacionais. Aplicou-se como método o modelo hipotético-dedutivo, percorrendo procedimentos de revisão bibliográfica.
