Response to mining disasters: legislative and regulatory changes regarding dam safety

This article portrays the evolution of Brazilian federal legislation in the face of disasters involving mining dams between the years 2001 to 2020. The central focus of this work was to answer the question: how the Brazilian federal legislative scenario has reacted to disasters in the mining sector? The research methodology used historical and documentary research. As specific objectives, we sought to understand: which measures were instituted by post-disaster legislation; whether the measures were relevant; how the dynamics of such changes took place (which bodies were involved and what were the contributions of society); when did the changes take place; and, finally, if it was possible to state that there was learning oriented to public policies. In conclusion, the results showed that Brazil responded to the disasters by creating and increasing the legislation put in place, especially with regard to technical aspects and dam monitoring. The changes, in general, denote an improvement in the norms, but it was verified that there is still a necessary space to be filled in this sense, mainly in the aspects related to the inspection by Organs competent bodies.
