Cooperation and scarcity: The role of flagrante delicto in the criminal justice system

Resumo: The purpose of this article is to understand how the flow of the criminal justice system for intentional homicide works. The Brazilian studies underline the existence of a loosely coupled system, highlighting that the disjunction among agencies in charge of investigating and prosecuting this crime would be due to difficulty in forging cooperation. The hypothesis to be tested is that, in a medium-sized city, there would be greater cooperation between agents and agencies, which would result in greater efficiency in the progression of intentional homicide (attempted and consummated) in the flow. As an empirical counterpoint, we have used quantitative and qualitative data gathered in Esmeraldas, a city in the Metropolitan Area of Belo Horizonte (RMBH). The results indicate that these lection pattern is similar to the one found in other studies, and the determining element of cooperation is flagrante delicto.

Los estúdios brasileños subrayan la existencia de un sistema débilmente acoplado, destacando que la disyunción entre los organismos encargados de investigar y perseguir este delito se debe a la dificultad para forjar la cooperación. La hipótesis a contrastar es que, en una ciudad mediana, habría una mayor cooperación entre agentes y agencias, lo que redundaria en una mayor eficiência em la progresión de los casos de homicidio intencional (intentado y consumado). Como contrapunto empírico, hemos utilizado datos cuantitativos y cualitativos recopilados en Esmeraldas, una ciudaddel Área Metropolitana de Belo Horizonte (RMBH). Los resultados indican que el patrón de selección es similar al encontrado enotros estudios, y el elemento determinante de la cooperación es el flagrante delito.O objetivo deste artigo é compreender como funciona o fluxo do sistema de justiça criminal para o homicídio doloso. Os estudos brasileiros destacam a existência de um sistema frouxamente acoplado, sublinhando que a disjunção entre os órgãos encarregados de investigar e processar esse crime seria decorrente da dificuldade de forjar cooperação. A hipótese a ser testada é que, em uma cidade de médio porte, haveria maior cooperação entre agentes e órgãos, o que resultaria em maior eficiência na progressão dos casos de homicídios dolosos (tentados e consumados) no fluxo do sistema de justiça. Como contraponto empírico, foram utilizados dados quantitativos e qualitativos coletados em Esmeraldas, município da Região Metropolitana de Belo Horizonte (RMBH).
