The right to quality of education in Brazil: a review of relevant legislation and pedagogical settings needed for a lawsuit

Resumo: This study aims to examine the legal feasibility of requiring in court the right to quality basic education, when this right, which should be provided by competent agencies (Executive Branch), is violated, disrespected and/or not effected. The methodology employed is the literature research with emphasis on the legal and educational areas, analyzing from books, to journals, documents and laws. The theoretical framework includes Romualdo Portela de Oliveira, Gilda Cardoso de Araújo, Sergio Haddad and Carlos Roberto Jamil Cury. This research has therefore as its major result some legal means capable of ensuring the quality of basic education. The discussion of the possibility of this demand is based on the analysis of three dimensions of educational quality: input, process and results. This research was fostered by CAPES.

This research was fostered by CAPES.Este estudo pretende analisar a viabilidade jurídica de se exigir judicialmente o direito à qualidade da Educação Básica, quando esse direito, que deveria ser assegurado pelos órgãos competentes (Poder Executivo), for violado, desrespeitado e/ou não efetivado. A metodologia empregada é a pesquisa bibliográfica com ênfase na área jurídica e educacional, por meio da análise de livros, periódicos, documentos e legislações. O referencial teórico utilizado inclui Romualdo Portela de Oliveira, Gilda Cardoso de Araújo, Sérgio Haddad e Carlos Roberto Jamil Cury. Esta pesquisa apresenta, portanto, como resultado principal, alguns meios jurídicos capazes de garantir a qualidade da Educação Básica, partindo da análise de três dimensões de qualidade educacional: insumos, processo e resultados.
