Forestry legislation in the passage from the eighteenth to the nineteenth century: permanence, ruptures and contradictions in the case of Santa Catarina Island

Resumo: Portuguese America should respond to laws, decrees, permits, and ordinations elaborated in the kingdom. Until the transfer of the court to Brazil in 1808, decisions regarding conquest in America, at least at the formal level, had Lisbon as the center. It was from the late eighteenth century that legislation focused on the forest issue began to be effectively formulated. This work aims to investigate such laws and decrees and the contexts under which they were elaborated, considering that they did not respond to preservationist interests, but rather economic ones. We will also consider the permanences, ruptures, and contradictions in the forestry legislation observed at the time. For this purpose, we present a case study on the island of Santa Catarina, from the eighteenth to the nineteenth century. We seek to articulate the understanding of the construction of this legal framework with the society of the end of the Old Regime, thus clarifying issues such as territoriality and power relations with the objective of demonstrating a change in the way of understanding and coping with the theme.

Hasta que el traslado de la corte a Brasil en 1808, las decisiones sobre los logros en América, al menos en el plano formal, tenían como centro de Lisboa. Fue a partir de finales del siglo XVIII que una legislación orientada a la cuestión forestal comenzó a ser efectivamente formulada. Este trabajo busca investigar tales leyes y decretos y los contextos bajo los cuales fueron elaborados, considerando  que las mismas no respondían a intereses preservacionistas, sino económicos. Ponderemos, además, sobre las permanencias, rupturas y contradicciones en la legislación de cuño forestal observadas en la época. Presentamos, para tal intento, un estudio de caso sobre la isla de Santa Catarina, en el paso del siglo XVIII al XIX. Se busca articular la comprensión de la construcción de ese marco legal con la sociedad de final de Antiguo Régimen, matizando cuestiones como territorialidad y relaciones de poder con el objetivo de demostrar un cambio en la forma de comprensión y enfrentamiento del tema.A América portuguesa deveria responder a leis, decretos, alvarás e ordenações elaborados no reino. Até a transferência da corte para o Brasil, em 1808, as decisões relativas às conquistas na América, ao menos em nível formal, tinham Lisboa como centro. Foi a partir do final do século XVIII que uma legislação voltada para a questão florestal começou a ser efetivamente formulada. Este trabalho visa investigar tais leis e decretos, e os contextos sob os quais foram elaborados, considerando que elas não respondiam a interesses preservacionistas, mas sim, econômicos. Ponderaremos, ainda, sobre as permanências, rupturas e contradições na legislação de cunho florestal observadas na época. Apresentamos, para tal intento, um estudo de caso sobrea Ilha de Santa Catarina, na passagem do século XVIII para o XIX.
