“To write, to be useful to society”: An analysis of Myrthes de Campos’s intellectual output

Resumo: Myrthes de Campos (1875-1965) is widely acknowledged as the first woman to have worked as a lawyer in Brazil. She received her law degree in 1898 and made her debut in a jury court the following year. Even though she often published in major newspapers and legal journals and presented contributions to academic conferences, her trajectory has received scarce attention from the point of view of intellectual history. This article presents an analysis of a group of texts in which she discussed the civil capacity of women, abortion, and jury courts. It argues that “the first woman lawyer” acted in ways that were more complex, contradictory, and challenging than depicting her as a pioneer or as an exceptional subject may suggest. By putting Myrthes de Campos’s writings in dialogue and in tension with her contemporaries, it aims to contribute to the study of women as intellectuals, as well as to the understanding of the changes legal practices and discourses underwent throughout the first decades of the twentieth century.

Se recibió de la carrera de derecho el año 1898 e hizo su estreno en un juicio por jurados al año siguiente. Si bien publicó con frecuencia en diarios de gran circulación y en revistas jurídicas, además de presentar sus trabajos en congresos académicos, la trayectoria de Myrthes de Campos ha recibido escasa atención desde el punto de vista de la historia intelectual. Este artículo analiza un conjunto de textos donde ella discutió la capacidad civil de las mujeres, el aborto y el juicio por jurados, buscando argumentar que “la primera abogada” de Brasil tuvo una actuación relevante, más compleja, contradictoria y cuestionadora de lo que las narrativas del pionerismo y de la excepcionalidad han sugerido. Al poner los escritos de Myrthes de Campos en diálogo y en tensión con sus contemporáneos, el objetivo es contribuir al estudio de las mujeres como intelectuales, así como también, a la comprensión de las transformaciones que experimentaron las prácticas y los discursos jurídicos a lo largo de las primeras décadas del siglo XX.Myrthes de Campos (1875-1965) é amplamente reconhecida como a primeira mulher a exercer a advocacia no Brasil. Ela se graduou em direito em 1898 e fez sua estreia no tribunal do júri no ano seguinte. Embora tenha publicado com frequência em jornais de grande circulação e em revistas jurídicas, bem como apresentado trabalhos em congressos acadêmicos, sua trajetória recebeu pouca atenção do ponto de vista da história intelectual. Este artigo apresenta uma análise de um conjunto de textos em que ela discutiu a capacidade civil das mulheres, o aborto e o tribunal do júri, procurando argumentar que “a primeira advogada” teve uma atuação mais complexa, contraditória e questionadora que as narrativas do pioneirismo e do excepcionalismo podem sugerir.
