Personal Data, Privacy and Democracy: A necessary contemporary relationship

Resumo: The present study has as objective to deepen the relation between personal data protection, privacy and democracy, mainly since recent developments that these themes have acquired with the increased profusion of innumerous content providers that daily collect and storage data and have reach to disseminate information among the Society. The study of these themes hereby proposed, such as data protection and privacy, is not something necessarily new among law Science, but its objective relation as a means to deepen democracy is the central point that this work aims to share its most advanced contributions. Central objective of this study if to deepen the relation between this objective dimension of data protection, privacy, with the maintenance and improvement of democratic possibilities, for this goal the methodology uses systematic bibliography revision, aiming to through dialectical method achieves the forecasted conclusions. This way it’s necessary to understand Fundamental Rights not only as individual liberties, but also in its intersubjective dimension which is essential to the continuity of a Democratic Rule of Law.

O estudo das temáticas aqui propostas, como a proteção de dados e a privacidade, não é algo necessariamente novo no âmbito da ciência jurídica, mas a relação em sua dimensão objetiva como meio de um aprofundamento da democracia é o ponto central que este trabalho visa dar sua contribuição mais avançada. O objetivo central do estudo é aprofundar a relação entre essa dimensão objetiva da proteção de dados, da privacidade, com a manutenção e aprimoramento das possibilidades democráticas, para tanto a metodologia utiliza-se da revisão bibliográfica sistemática, buscando através do método dialético obter as conclusões esperadas.
