STF and separation of powers - Interference by the STF in the independent formation and self-organization of the Executive and Legislative branches between 2015 and 2018

Resumo: The purpose of the thesis is to analyze the separation of Powers and the relationship between the STF and the other Powers during the period 2015-2018 (related to or resulting from the Operation Car Wash/ “Lava Jato”). Considering that the separation of Powers is a constitutional principle, it has normative force and is a limiter to be complied with by all Powers in their respective spheres of action. The essential content of the separation of Powers has an absolute and dynamic character, so that it is necessary to identify it from the historical aspect, under the Brazilian characteristics and according to the concrete performance of the Powers. Although it is not feasible to exhaustively describe all the characteristics of the separation of powers, it is possible to identify some of its constituent elements, among them, the independent formation and self-organization of the Powers. From this, we can assess whether the Supremo Tribunal Federal (Brazilian Supreme Court) judged the selected jurisprudence cases in the constitutionally appropriate manner and, thereby, determine whether the STF's posture was institutionally correct (and its effects on the democratic system).

Considerando que la separación de Poderes es un principio constitucional, tiene fuerza normativa y es un límite que debe ser observado por todos los Poderes en sus respectivas esferas de acción. El contenido esencial de la separación de Poderes tiene carácter absoluto y dinámico, siendo necesario identificarlo desde el aspecto histórico, bajo las particularidades brasileñas y según la actuación concreta de los Poderes. Si bien no es factible describir de manera exhaustiva todas las características de la separación de poderes, sí es posible identificar algunos de sus elementos constitutivos, entre ellos, la formación independiente y la autoorganización de los poderes. A partir de ello, podremos evaluar si el Supremo Tribunal Federal juzgó los casos de la jurisprudencia seleccionada de manera constitucionalmente adecuada y, con ello, determinar si la postura del STF fue institucionalmente correcta (y los efectos de ello en el sistema democrático).O objetivo desta tese é analisar a separação dos Poderes e, em especial, a relação do STF com os demais Poderes durante o período de 2015-2018 (relacionados ou decorrentes da Operação Lava Jato). Considerando que a separação dos Poderes é um princípio constitucional, ela possui força normativo e é um limitador a ser observado por todos os Poderes em suas respectivas esferas de atuação. O conteúdo essencial da separação dos Poderes possui caráter absoluto e dinâmico, sendo necessário identificá-lo a partir do aspecto histórico, sob as particularidades brasileiras e conforme a atuação concreta dos Poderes. Ainda que não seja viável descrever exaustivamente todas as características da separação dos Poderes, é possível identificar alguns de seus elementos constitutivos, entre eles, a formação independente e a auto-organização dos Poderes.
