Resumo: Enterprises and companies engaged in risky activities have faced great difficulty in meeting the quota for hiring disabled people, established by Law 8.213/91. The regulatory agencies have punished companies too hard, regardless to whether it is possible for the disabled to perform certain activity because of their physical handicap, without putting their lives their co-workers at risk. It is not a matter of being opposite to the legislation protecting the handicapped who enters the labor market, but for the calculation of the quota it is desirable that the law establishes criteria for auditing which can verified and established, from existing positions in the company, which ones are able to be exercised by the disabled

Os órgãos fiscalizadores vêm punindo as empresas com rigor, sem levar em conta se é possível o deficiente exercer determinada atividade em virtude de sua limitação física, sem colocar a sua vida e de terceiro em risco.
